Who I am
Modealy is the trade name of Julien de le Vingne, self-employed, based in Belgium. I decide how the personal data described here is used, so I am its controller under the GDPR (the EU data protection law).
For any question or request about your data, write to julien@modealy.com.
When you visit this website
This site uses Cloudflare Web Analytics, which counts visits without cookies and without identifying you, and Cloudflare Stream to play the videos, which records minutes watched. No tracking cookies are set.
When you book a call, Google Calendar receives the details you type in the booking form: your name, your email address and any answers you give. I use them to hold the call and prepare for it. The legal basis is the steps you asked for before we might work together.
When I contact you by email
I send cold emails to businesses whose activity makes my service relevant to them. For this I use:
- your name, work email address, job title, company, company website and location;
- sometimes a business phone number;
- a short description of your company, written from its public website.
These data come from business contact databases, company websites and public professional profiles. If you ask, I tell you exactly where yours came from.
The legal basis is my legitimate interest in contacting businesses about a service that fits their role (article 6(1)(f) GDPR). Every email lets you opt out. Reply that you are not interested, or ask me to stop, and I stop. I then keep your address on a do-not-contact list, only so that it never happens again.
When I call you
I sometimes call businesses I have emailed, on a business phone number. I keep short notes of the call.
Call recording. I record some calls so I can review them and improve how I call. Where the law asks for it, I tell you at the start of the call, and you can say no: I then stop the recording. Recordings are kept for 90 days, then deleted. You can ask me at any time to delete yours sooner.
When you are a client
If we work together, our service agreement sets how I handle data. Lists you give me, such as customer exports or your do-not-contact list, are used only on your instructions, under the data-processing terms of that agreement.
Who else handles the data
Service providers handle data on my behalf and only for the purposes above: email and calendar (Google Workspace), the email sending platform, email verification services, the phone system, and cloud storage and automation tools. Some of them are based in the United States. Those transfers are covered by the EU–US Data Privacy Framework or by the EU standard contractual clauses.
I never sell personal data.
How long I keep it
- Prospect data: up to 12 months after my last contact with you, then deleted or anonymised.
- Do-not-contact records: for as long as I send cold emails, so that your opt-out keeps working.
- Call recordings: 90 days.
- Booking and client data: for as long as we work together, and invoices for as long as Belgian accounting law requires.
Your rights
You can ask me to show you the data I hold about you, to correct it, to delete it, to limit its use, or to give it to you in a usable file. You can object to its use for prospecting at any time, with no reason needed. Write to julien@modealy.com and I answer within one month.
If you think I have not respected your rights, you can complain to the Belgian Data Protection Authority: dataprotectionauthority.be.
